What happened in the Pan Masala advertisement case ?
On October 30, 2026, Maharashtra FDA Commissioner Tukaram Mundhe announced that proceedings at the investigation stage had been completed against the three Bollywood actors.
According to the FDA, the advertisements promoting Vimal Elaichi allegedly functioned as indirect advertisements for Vimal Pan Masala, a product covered by Maharashtra's prohibition measures.
The FDA had issued show-cause notices in August 2026, asking the actors to explain their involvement, disclose relevant endorsement arrangements and address concerns about the promotional campaigns.
The regulator has now indicated that the case will be placed before the joint commissioner, the competent adjudicating authority, during the first week of November 2026.
Why are the advertisements controversial ?
The dispute centres on surrogate advertising, a practice in which a company promotes a restricted product indirectly through another product carrying the same or similar branding.
For example, advertisements may feature cardamom or mouth fresheners while using brand names, visual designs and promotional messages associated with pan masala.
Maharashtra authorities allege that the Vimal Elaichi campaigns effectively promoted the Vimal Pan Masala brand despite restrictions on the relevant products.
The FDA's August notices specifically raised concerns about the presentation, dialogue, branding and commercial context of the advertisements.
What did the courts decide ?
An earlier legal challenge was filed by PB Agro LLP, the master licensee associated with the Vimal brand, before the Delhi High Court.
On September 15, 2026, Justice Swarana Kanta Sharma declined to entertain the petition on territorial jurisdiction grounds. The court indicated that Maharashtra courts were the more appropriate forum for challenging notices issued by Maharashtra authorities.
Importantly, the Delhi High Court did not decide whether the actors had violated advertising laws. Its decision concerned where the dispute should be heard.
Ajay Devgn has subsequently approached the Bombay High Court in connection with the case. The Maharashtra FDA has stated that its regulatory proceedings will continue notwithstanding that legal challenge.
What penalties could the actors face ?
Earlier reporting on the FDA notices indicated that endorsers could face penalties of up to ₹10 lakh under the applicable misleading-advertisement framework.
Nevertheless, no final penalty against Shah Rukh Khan, Ajay Devgn or Tiger Shroff has been established in the October 30 announcement.
The adjudicating authority will need to consider the evidence, applicable legal provisions and responses from the parties before determining any consequences.
Timeline of the controversy
Date Development July 13, 2026 Maharashtra prohibition order referenced in the FDA's subsequent notices August 2026 FDA issues show-cause notices to the three actors September 15, 2026 Delhi High Court declines to hear the brand licensee's challenge on territorial jurisdiction grounds October 30, 2026 FDA announces completion of its investigation and findings of violations Early November 2026 Case expected to be referred for adjudication
What happens next ?
The case will move to adjudication, where the competent authority can examine the allegations and the actors' responses before issuing a determination.
The proceedings could have wider implications for celebrity endorsements, particularly advertisements involving products associated with restricted tobacco or pan masala brands.
The central legal question is whether advertising a permitted product under a shared brand identity constitutes unlawful indirect promotion of a prohibited product.
The October 30 development represents a significant regulatory step in the Vimal Pan Masala advertising controversy. Maharashtra's FDA says its investigation has identified violations involving three prominent Bollywood actors, but the matter has not yet reached a final adjudicated outcome.
Any reporting should distinguish between the FDA's findings, the Delhi High Court's jurisdictional ruling and a future final decision on liability.
